There is absolutely no way to get around this. If you have the invoice of the phone, then you can probably return it under warranty with the IMEI.

In settings there should be option to factory reset, but there also should be an accounts field where you could remove the account and add yours, but to get rid of anything left behind from previous user the factory reset would be better option.
