It's a gray area, your word against theirs. Unless you can find 100 people who have had the same problem, you have little chance of making a successful claim. Hopefully, the time will soon come when induction charging and Bluetooth will make it possible to build completely sealed underwater cameras.

When I turn my FUJI FINEPIX S5000 on the excessive hand shake warning shows on the display The camera will not take photos and there is nothing to be seen through the viewfinder

Take it to your local service centre - sounds as if there is a glitch in the electronics. I presume you have followed all the troubleshooting advice in the manual, including performing a reset?
